These terms and conditions apply to your use of the GetSafeNow platform — the mobile application (available on Google Play and App Store) and https://getsafenow.app. By using the platform, you agree to these terms and our Privacy Policy.
Please read these conditions carefully before using the platform.
1. Acceptance of Terms
By using the platform, you agree to be bound by this agreement. If you do not agree, you must not use our services. We may modify this agreement at any time; continued use after modifications constitutes acceptance.
2. Notifications
By providing your email address, you agree that we may send notifications about GetSafeNow. You may opt-out at any time using the "unsubscribe" link in any email or by contacting us.
3. Encrypted Messaging Services
GetSafeNow uses end-to-end encryption for all messages. Only the sender and receiver can access message content. GetSafeNow cannot read or alter messages in transit or storage.
Platform features include:
- Individual and Group Messaging: Secure messaging with end-to-end encryption in all conversations
- Privacy Controls: Set rooms as public or invitation-only
- Encrypted File Transfer: Send files up to 100 MB, fully encrypted end-to-end
- Encrypted Voice Calls: One-to-one and group voice calls over WiFi or data with end-to-end encryption
- Encrypted Video Calls: Secure one-to-one and group video calls with end-to-end encryption
4. Legal Compliance
If legally required to disclose information, we will only provide data we are required to disclose and to the extent technically possible without compromising user security. GetSafeNow never has access to your encrypted messages.
5. Subscriptions
Basic use of the platform is free. Additional features are available through paid subscriptions. Subscriptions include automatic billing on the billing date. You may cancel any subscription before the next billing period to avoid renewal charges. Upon cancellation, paid features remain available until the end of the current billing period.
6. Payments
Subscriptions may be paid by credit or debit card (Visa, Mastercard, Discover, Amex, Diners). All payments are processed by Stripe (stripe.com). GetSafeNow never has access to your payment information. For billing inconsistencies, contact us or Stripe's customer service directly.
7. Restrictions on Use
Use of the platform is subject to the following prohibitions:
- Using the services for any illegal, fraudulent, abusive or harmful purpose
- Distributing malware, viruses, spyware or other malicious software
- Harassing, intimidating, threatening, defaming or violating the privacy of others
- Sending spam, unsolicited advertising or unauthorized bulk messages
- Engaging in phishing, impersonation or other fraudulent activity
- Attempting to gain unauthorized access to accounts, systems or data
- Violating the security or availability of the services
- Distributing content that infringes intellectual property rights
- Coordinating or participating in illegal activities
- Creating more than one account per individual
8. Limitation of Liability
GetSafeNow does not guarantee that services will be available without interruption or error at all times. Use of GetSafeNow is at the user's own risk. To the maximum extent permitted by law, GetSafeNow shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages arising from use or inability to use the services.
Users agree to indemnify and hold GetSafeNow harmless from any claim or demand, including reasonable attorneys' fees, arising from their use of the platform, violation of these terms, or violation of any third-party rights.
9. License to Use the Platform
GetSafeNow grants you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the platform solely for its intended purposes as permitted by these terms. This license does not permit resale or commercial exploitation of the platform.
10. Copyright
All content on the platform, including names, logos, trademarks, images, text, graphics, videos, and software, is protected by copyright, trademarks and/or other intellectual property rights owned by GetSafeNow or licensed third parties. No material may be copied, reproduced, republished, sold, downloaded, posted, transmitted or distributed without GetSafeNow's prior express written permission.
11. Copyright Infringement (DMCA)
GetSafeNow responds to copyright infringement notices pursuant to Section 512 of the Digital Millennium Copyright Act (DMCA). If you believe any material infringes your copyright, please send a notice to legal@getsafenow.app including: identification of the infringed work; location of the infringing material; your contact information; a good faith belief statement; and your signature.
12. Prohibited Activities
In addition to Section 7, the following are prohibited: scraping or automated data collection; framing or mirroring any part of the platform; attempting to reverse engineer any software; circumventing security features; and any activity that imposes unreasonable load on our infrastructure.
13. Disclaimer of Warranties
To the maximum extent permitted by law, GetSafeNow excludes all warranties, express or implied. GetSafeNow shall not be liable for any failure to perform due to events beyond its reasonable control, including Internet outages, fire, flood, or other acts of nature.
14. Electronic Communications
GetSafeNow is not responsible for failed, partial or garbled computer transmissions, or for any breakdown or failure of computer, telephone, network, electronic or Internet hardware or software.
15. Indemnification
You agree to defend and indemnify GetSafeNow from and against any claims, damages, fines, penalties or costs including reasonable legal fees, brought by third parties as a result of your breach of this agreement, violation of any law, or use of the platform.
16. Changes
We may change the platform and these terms at any time, at our sole discretion and without notice. Continued use of the platform constitutes acceptance of any changes.
17. Severability
If any section of these terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
18. Force Majeure
GetSafeNow shall not be liable for any failure due to causes beyond its reasonable control, including acts of civil or military authorities, riots, natural disasters, or other unforeseen circumstances.
19. Termination
Failure to comply with these terms may result in termination of your access to the platform. GetSafeNow reserves the right to terminate access without prior notice for any violation of these terms.
20. Disputes
Any dispute arising from these terms shall preferably be resolved by binding arbitration between you and GetSafeNow before a recognized arbitration entity. You agree, to the extent permitted by law, not to initiate or participate in class action lawsuits related to the platform.
21. Governing Law
These terms shall be governed by and construed in accordance with the laws of the United States, specifically the State of Wyoming. Any dispute shall be subject to the exclusive jurisdiction of the state or federal courts of Wyoming, unless binding arbitration is agreed.
22. Integration
This agreement, together with the Privacy Policy and any other legal notices published by GetSafeNow, constitutes the entire agreement between you and GetSafeNow regarding your use of the platform.
