These terms and conditions apply to your use of the GetSafeNow platform — the mobile application (available on Google Play and App Store) and https://getsafenow.app. By creating an account or using the platform, you agree to these terms and our Privacy Policy.
Please read these conditions carefully before using the platform.
1. Acceptance of Terms
By creating an account, subscribing, or using the platform, you agree to be bound by this agreement. If you do not agree, you must not use our services.
We may modify this agreement at any time. For non-material changes, we will update the "Last Updated" date at the top of this page. For material changes, we will provide at least 30 days' notice via email to all registered users. Continued use of the platform after changes take effect constitutes acceptance of the revised terms.
2. Notifications
By providing your email address, you agree that we may send you notifications about GetSafeNow, including product updates and promotional communications. You may opt-out of promotional emails at any time using the "unsubscribe" link in any email or by contacting us at [email protected].
Note: transactional and service emails (such as payment receipts, billing notices, and server status updates) are not subject to opt-out and will be sent as necessary to maintain your account.
3. Encrypted Messaging Services
GetSafeNow uses end-to-end encryption for all messages. Only the sender and receiver can access message content. GetSafeNow cannot read or alter message content in transit or storage. As with all communication services, certain metadata (such as account activity and server logs) may be retained as described in our Privacy Policy.
Platform features include:
- Individual and Group Messaging: Secure messaging with end-to-end encryption in all conversations
- Privacy Controls: Invitation-only or open-join rooms, all protected by end-to-end encryption
- Encrypted File Transfer: Send files fully encrypted end-to-end — up to 50 MB on the free tier, up to 100 MB on private server plans
- Encrypted Voice Calls: One-to-one and group voice calls over WiFi or data with end-to-end encryption
- Encrypted Video Calls: Secure one-to-one and group video calls with end-to-end encryption
4. Legal Compliance
If legally required to disclose information, we will only provide data we are required to disclose and to the extent technically possible without compromising user security. GetSafeNow never has access to your encrypted message content.
GetSafeNow maintains a warrant canary at getsafenow.app/transparency. This page is updated periodically to confirm whether GetSafeNow has received any national security letters, gag orders, or similar legal demands that would prevent disclosure.
5. Subscriptions
Basic use of the platform is free. Additional features are available through paid subscriptions. Current subscription pricing is available at getsafenow.app/#pricing.
Subscriptions automatically renew on a monthly basis and your payment method will be charged on the same date each month. You may cancel any subscription before the next billing period to avoid renewal charges. Upon cancellation, paid features remain available until the end of the current billing period.
All subscription fees are non-refundable. Cancellation stops future billing but does not entitle you to a refund of any amounts already charged.
If a payment fails, we will retry the charge and notify you by email. If payment is not received within 30 days, your private server will be deprovisioned and access suspended. During this 30-day period, if all due and past-due payments are received in full, your server will be reactivated and access restored. After 30 days without payment, your server and all associated data will be permanently deleted and cannot be recovered.
6. Payments
Subscriptions may be paid by credit or debit card and other payment methods supported by Stripe. All payments are processed by Stripe (stripe.com). GetSafeNow never has access to your payment information. All charges are in US dollars (USD).
If your payment fails, GetSafeNow will notify you by email so you may update your payment method. You may manage your subscription and billing details directly at billing.getsafenow.app or by contacting us at [email protected].
7. Prohibited Activities
Use of the platform is subject to the following prohibitions:
- Using the services for any illegal, fraudulent, abusive, or harmful purpose
- Distributing malware, viruses, spyware, or other malicious software
- Harassing, intimidating, threatening, defaming, or violating the privacy of others
- Sending spam, unsolicited advertising, or unauthorized bulk messages
- Engaging in phishing, impersonation, or other fraudulent activity
- Attempting to gain unauthorized access to accounts, systems, or data
- Violating the security or availability of the services
- Distributing content that infringes intellectual property rights
- Coordinating or participating in illegal activities
- Creating more than one account per individual, except as expressly permitted by GetSafeNow
- Sharing, distributing, or possessing child sexual abuse material (CSAM) or any content that sexually exploits minors
- Using the services in violation of US export control laws or economic sanctions, including providing access to sanctioned individuals or countries
- Promoting, glorifying, or facilitating acts of terrorism, genocide, or mass violence
- Scraping or automated data collection
- Framing or mirroring any part of the platform
- Attempting to reverse engineer any software, except as permitted by applicable law or with GetSafeNow's prior written consent for legitimate security research
- Conducting denial of service attacks or any activity that intentionally disrupts or degrades the performance of the platform
- Creating accounts or sending messages via automated means without GetSafeNow's prior written consent
8. Limitation of Liability
GetSafeNow does not guarantee that services will be available without interruption or error at all times. Use of GetSafeNow is at the user's own risk.
To the maximum extent permitted by law, GetSafeNow shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from use or inability to use the services, including any loss of data, messages, files, or other content stored on the platform. In no event shall GetSafeNow's total liability exceed the amount you paid to GetSafeNow in the 12 months preceding the claim.
GetSafeNow shall not be liable for any failure to perform due to events beyond its reasonable control as described in Section 16 (Force Majeure).
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.
9. License to Use the Platform
GetSafeNow grants you a personal, non-assignable, and non-exclusive license to use the platform solely for its intended purposes as permitted by these terms. This license does not permit resale or commercial exploitation of the platform. This license terminates automatically upon termination of your account or expiration of your subscription.
10. Copyright
All content on the platform, including names, logos, trademarks, images, text, graphics, videos, and software, is protected by copyright, trademarks and/or other intellectual property rights owned by GetSafeNow or licensed third parties. No material may be copied, reproduced, republished, sold, downloaded, posted, transmitted, or distributed without GetSafeNow's prior express written permission.
The platform incorporates open source software, including the Matrix protocol and related components such as Element Call, which are licensed under their respective open source licenses. Nothing in this section restricts rights granted under those open source licenses. A full list of open source components is available at getsafenow.app/open-source.
11. Copyright Infringement (DMCA)
GetSafeNow responds to copyright infringement notices pursuant to Section 512 of the Digital Millennium Copyright Act (DMCA). If you believe any material infringes your copyright, please send a notice to [email protected] including:
- A physical or electronic signature of the copyright owner or authorized agent
- Identification of the copyrighted work claimed to be infringed
- Identification of the infringing material and its location on the platform
- Your contact information, including address, phone number, and email
- A statement of good faith belief that the use is not authorized by the copyright owner
- A statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner
Note: due to end-to-end encryption, GetSafeNow cannot access or remove encrypted message content. DMCA notices are therefore applicable only to unencrypted content such as website and marketing materials.
Counter-Notification: If you believe your content was removed in error, you may submit a counter-notification to [email protected] including your contact information, identification of the removed material, a statement under penalty of perjury that removal was a mistake, and your consent to jurisdiction of the federal court in Wyoming.
12. Disclaimer of Warranties
To the maximum extent permitted by law, GetSafeNow excludes all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
GetSafeNow does not warrant that the platform will be operational, error-free, secure, or safe, or that it will function without disruptions, delays, or imperfections.
GetSafeNow makes no warranties regarding third-party services integrated with the platform, including but not limited to Stripe, Cloudflare, and LiveKit.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
13. Indemnification
You agree to defend and indemnify GetSafeNow and its officers, directors, employees, and agents from and against any claims, damages, fines, penalties, or costs including reasonable legal fees, brought by third parties as a result of your breach of this agreement, violation of any law, or use of the platform.
GetSafeNow reserves the right to assume exclusive control of the defense of any matter subject to indemnification, at your expense. You agree to cooperate fully with GetSafeNow's defense of such claims.
14. Changes
We may update the platform and these terms at any time at our sole discretion. For non-material changes, we will update the "Last Updated" date at the top of this page. For material changes, we will provide at least 30 days' notice via email to all registered users. Continued use of the platform after changes take effect constitutes acceptance of the revised terms.
15. Severability
If any section of these terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
16. Force Majeure
GetSafeNow shall not be liable for any failure due to causes beyond its reasonable control, including but not limited to acts of civil or military authorities, government actions, riots, war, terrorism, natural disasters, pandemics, labor disputes, Internet or telecommunications failures, power outages, or other unforeseen circumstances beyond GetSafeNow's reasonable control.
GetSafeNow will make reasonable efforts to notify affected users and resume services as quickly as practicable.
17. Termination
GetSafeNow reserves the right to terminate or suspend your access to the platform at any time. For minor violations of these terms, GetSafeNow will provide written notice and a 7-day cure period before termination. For serious violations — including but not limited to illegal activity, distribution of CSAM, terrorism, security attacks, or abuse — GetSafeNow may terminate access immediately and without prior notice.
Upon involuntary termination for violations, no refund will be issued and your server and all associated data will be deleted immediately.
You may terminate your account at any time by cancelling your subscription via billing.getsafenow.app or by contacting us at [email protected]. Upon voluntary cancellation, the terms of Section 5 (Subscriptions) apply regarding data retention and server deprovisioning.
The following sections shall survive termination of this agreement: Limitation of Liability, Indemnification, Disputes, and Governing Law.
18. Disputes
Before initiating any formal dispute, you agree to contact GetSafeNow at [email protected] and attempt to resolve the dispute informally for at least 30 days.
If informal resolution fails, any dispute arising from these terms shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Either party may bring individual claims in small claims court as an alternative to arbitration.
You waive any right to participate in a class action lawsuit or class-wide arbitration, to the extent permitted by law.
GetSafeNow will pay arbitration filing fees for claims under $10,000 unless the arbitrator finds the claim frivolous.
19. Governing Law
These terms shall be governed by the laws of the State of Wyoming, without regard to its conflict of law provisions. Any dispute not subject to arbitration under Section 18 shall be subject to the exclusive jurisdiction of the state or federal courts of Wyoming, except for disputes resolved through binding arbitration or small claims court as provided in Section 18.
Notwithstanding the arbitration clause, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm.
20. Integration
This agreement, together with the Privacy Policy and Cookie Policy, constitutes the entire agreement between you and GetSafeNow regarding your use of the platform. This agreement supersedes any prior agreements, representations, or understandings between you and GetSafeNow regarding the platform.
