1. Acceptance of Terms
These Terms of Use ("Terms") govern your use of the GetSafeNow mobile application ("App"), operated by Get Safe Now LLC ("Company", "we", "us", "our"). By accessing or using the App, you confirm that you are at least 13 years of age, have read and understood these Terms, and agree to be bound by them.
We reserve the right to modify these Terms at any time. Continued use of the App after any modification constitutes acceptance of the updated Terms. We will make reasonable efforts to notify users of material changes via in-app notification or email.
2. Description of Service
GetSafeNow provides an end-to-end encrypted messaging platform, including private and group messaging, voice and video calls, and file transfer. The App is available as a free tier on our shared server or as a paid subscription providing a dedicated private server.
3. End-to-End Encryption
Your messages are end-to-end encrypted. This means only you and the intended recipient(s) can read your messages. GetSafeNow has no ability to read, access, or decrypt your messages — not even upon request from law enforcement or any other third party.
Because of this architecture, if you lose access to your account, your device, or your encryption keys, we cannot recover your message history. You are solely responsible for maintaining access to your account credentials and encryption key backups.
4. Data Loss — Limitation of Liability

Get Safe Now LLC is not responsible for any loss of data, messages, files, or any other content stored or transmitted through the App, for any reason whatsoever.
This includes, but is not limited to, data loss resulting from: server failure or outage; hardware failure; software bugs or errors; accidental deletion by you or another user; loss of account access; loss of encryption keys; network disruptions; force majeure events; actions of third parties; migration between servers; account termination; or any other cause, whether foreseeable or not.
Due to the end-to-end encrypted nature of the App, we have no ability to recover lost messages, media, or files under any circumstances. You are solely responsible for maintaining backups of any data you wish to preserve.
To the maximum extent permitted by applicable law, Get Safe Now LLC's total liability to you for any data loss shall be zero.
5. Limitation of Liability
To the maximum extent permitted by applicable law, Get Safe Now LLC and its officers, directors, employees, agents, affiliates, and licensors shall not be liable for any:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, business, or goodwill
- Loss of messages, media, files, or any other content
- Damages resulting from unauthorized access to your account
- Damages resulting from interruption or cessation of service
- Damages resulting from bugs, viruses, or malicious code transmitted through the App
- Damages resulting from your reliance on any information obtained through the App
- Damages of any kind arising out of or in connection with your use or inability to use the App
This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if Get Safe Now LLC has been advised of the possibility of such damages.
In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability is limited to the greatest extent permitted by law. In no event shall our total aggregate liability to you exceed the amount you paid us in the 12 months immediately preceding the claim, or $100 USD, whichever is less.
6. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranty of any kind, express or implied. To the maximum extent permitted by applicable law, we expressly disclaim all warranties, including:
- Merchantability, fitness for a particular purpose, and non-infringement
- That the App will be uninterrupted, error-free, or secure at all times
- That defects will be corrected
- That the App or servers are free of viruses or harmful components
- That the App will meet your specific requirements
- That any data transmitted through the App will be transmitted securely and without interception
No advice or information, whether oral or written, obtained from us or through the App, shall create any warranty not expressly stated in these Terms.
7. Service Availability
We do not guarantee that the App or its services will be available at all times. The App may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue the App or any part thereof at any time, with or without notice.
Get Safe Now LLC shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App or any service, content, feature, or product offered through the App.
8. User Responsibilities
You are solely responsible for:
- Maintaining the confidentiality and security of your account credentials
- All activity that occurs under your account
- Backing up any data, messages, or files you wish to preserve
- Ensuring your device meets the minimum requirements to run the App
- Complying with all applicable laws in your jurisdiction when using the App
- Any harm or damage caused by sharing your account credentials with others
You must notify us immediately at legal@getsafenow.app if you become aware of any unauthorized use of your account.
9. Acceptable Use
You agree not to use the App to:
- Engage in any illegal activity or facilitate illegal acts
- Harass, threaten, defame, or violate the rights of others
- Transmit spam, malware, viruses, or malicious code
- Impersonate any person or entity
- Attempt to gain unauthorized access to other accounts or systems
- Reverse engineer, decompile, or disassemble the App
- Exploit the App in any manner that could damage, disable, or impair it
- Coordinate or facilitate criminal activity, terrorism, human trafficking, or child exploitation
- Violate any applicable export control laws or regulations
Violation of these terms may result in immediate account termination without notice and without refund.
10. Subscriptions and Payments
Paid subscriptions are billed monthly and renew automatically unless cancelled before the next billing period. All payments are processed by Stripe. We do not store payment card information.
Subscription fees are non-refundable except where required by applicable law. If you cancel, you retain access to paid features until the end of the current billing period.
Get Safe Now LLC reserves the right to change subscription pricing at any time with reasonable notice. Continued use after a price change constitutes acceptance of the new pricing.
11. Account Termination
We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice, including for violations of these Terms. Upon termination:
- Your access to the App and any associated data will be revoked
- Any data stored on our servers may be deleted
- We have no obligation to retain or provide copies of your data
- No refund will be issued for any unused portion of a subscription, except where required by law

12. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of information as described in our Privacy Policy.
13. Intellectual Property
The App, including its design, code, trademarks, logos, and all content created by Get Safe Now LLC, is the exclusive property of Get Safe Now LLC and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App solely for its intended personal or business communication purposes.
You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works of any part of the App without our prior written consent.
14. Third-Party Services
The App integrates with third-party services including Stripe (payment processing) and cloud infrastructure providers. These services are subject to their own terms and privacy policies. Get Safe Now LLC is not responsible for the practices of any third-party services.
Links to third-party websites or services within the App are provided for convenience only. We do not endorse and are not responsible for the content or practices of any linked third-party sites.
15. Legal Compliance and Government Requests
Due to the end-to-end encrypted nature of the App, Get Safe Now LLC does not have access to the content of your messages and therefore cannot provide message content to any third party, including law enforcement, even if legally compelled to do so.
We may be required to provide non-content metadata (such as account registration information) in response to valid legal process. We will make reasonable efforts to notify affected users of any such requests, to the extent permitted by law.
16. Indemnification
You agree to indemnify, defend, and hold harmless Get Safe Now LLC and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
- Your use of or inability to use the App
- Your violation of these Terms
- Your violation of any rights of another party
- Your violation of any applicable laws or regulations
- Any content you transmit through the App
17. Dispute Resolution
Any dispute arising from or relating to these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of a recognized arbitration body, selected by mutual agreement.
You agree, to the extent permitted by applicable law, not to participate in class action lawsuits against Get Safe Now LLC. All claims must be brought in your individual capacity and not as a plaintiff or class member in any class or representative proceeding.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, specifically the State of Wyoming, without regard to its conflict of law provisions. Any disputes not resolved by arbitration shall be subject to the exclusive jurisdiction of the courts of Wyoming.
19. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
20. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published by Get Safe Now LLC, constitute the entire agreement between you and Get Safe Now LLC regarding your use of the App and supersede all prior agreements and understandings.
